Terms of Service

1. Acceptance of Terms

By accessing, browsing, registering for, or using Paperbird (the "Platform" or "Service"), you agree to be bound by these Terms of Service (the "Agreement") and our Community Guidelines. If you do not agree to all terms of this Agreement, you must immediately cease all use of the Service.

2. User Eligibility and Age Restrictions

You must be at least 13 years of age (or the minimum legal age of digital consent in your country of residence) to register an account or use this Service. If you are under the age of 13, you are strictly prohibited from registering an account, posting content, or submitting any personal information to the Service.

Mature Content Access: The Service allows authors to publish content containing mature themes. You must be at least 18 years of age (or the legal age of majority in your jurisdiction, whichever is older) to view, read, write, comment on, or otherwise interact with any content designated with Warning tags representing mature themes (including, but not limited to, Gore, Sexual Content, Abuse, Self-Harm, or Suicide). By accessing such content, you warrant that you are at least 18 years of age.

3. Intellectual Property & Licensing

Ownership: You retain 100% ownership of the copyright to any original literary text, chapters, titles, and comments you submit or publish on Paperbird.

License to Platform: By submitting, posting, or displaying content on or through the Service, you grant Paperbird a non-exclusive, royalty-free, worldwide, transferable, and sublicensable (solely to our technical infrastructure partners, such as hosting and CDN providers, for the purpose of delivering the Service) license to host, store, cache, format, distribute, transmit, reproduce, and publicly display your work.

This license exists solely to allow us to provide, display, and maintain the Platform. This license terminates when you delete your content or close your account.

4. Strict Content Restrictions

You represent and warrant that you hold all necessary distribution and copyright permissions for any literary work or images you upload. Any violation of the following restrictions constitutes a material breach of this Agreement and will result in immediate termination of your account and removal of your content:

  • No AI-Generated Content: All submitted text or images must be entirely authored by a human. Generative AI is strictly prohibited.
  • No Unauthorised Fan-Fiction: Derivative works based on copyrighted intellectual property (including third-party books, movies, television, games, anime, or manga) are not allowed.
  • Mandatory Cover Art Credit: Any uploaded cover art or profile imagery must belong to you, reside in the public domain, or be used with explicit permission. You must provide visible, accurate artist attribution in the metadata fields provided.
  • No Explicit (NSFW) Content: Pornography, erotica intended for sexual gratification, and sexually explicit images are prohibited.

5. Prior Publication Rights Advisory

Publishing your creative work publicly on Paperbird makes it freely accessible to the public on the internet. You acknowledge that doing so may constitute "prior publication" under standard literary industry definitions. This may limit or waive your ability to sell first serial or publishing rights to traditional print publishers, digital journals, or literary magazines in the future.

6. Copyright Policy & DMCA safe harbor

Paperbird respects the intellectual property rights of others and operates under the safe harbor protections of the Digital Millennium Copyright Act ("DMCA"). If you believe that your copyrighted work has been copied or posted on our Platform without authorization, please submit a formal DMCA Takedown Notice to the designated administrator:

Your notice must include a link to the specific infringing material on our site.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PAPERBIRD AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, INCLUDING ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT; OR
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

8. Disclaimer of Warranties ("As Is")

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Paperbird makes no warranties, express or implied, regarding the security, reliability, availability, or accuracy of the Service. You acknowledge that Paperbird is not a file backup service, and you are solely responsible for maintaining local copies and backups of any material you write or upload. Paperbird is not liable for any technical failures resulting in the loss of text, drafts, or metadata.

9. Indemnification

You agree to defend, indemnify, and hold harmless Paperbird and its operators, developers, and administrators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or any infringement of third-party copyright, intellectual property, or privacy rights by your submitted content.

10. Term, Modification, and Termination

We reserve the right, at our sole discretion, to modify or replace these Terms at any time by posting updated terms on the Service. We also reserve the absolute right to suspend, terminate, or delete any account or remove any submitted content at our sole discretion, for any reason or no reason, without prior notice or liability.
